Phoenix Cops Use Tricks On People Leaving Bars, Arizona DUI Defense Lawyer Discloses
Many cops who specialize in DUI arrests have taken to hanging around bars and pulling people over as they leave the bar so they can charge them with an Arizona DUI.
They joke that this kind of DUI arrest during a police stop is like shooting fish in a barrel. However, they never want to admit that was exactly what they are doing when asked why they stop you.
The Arizona DUI law says that in order to stop you, the police must have a reason, such as a traffic violation. Of course every person leaving a bar who is not driving drunk will be careful not to violate traffic laws.
But even if you are careful, the police will stop you for things you did not even know were a violation. As an Arizona DUI defense lawyer, let me tell you that I have seen these things when my clients were stopped after leaving a bar.
And they become the basis for your Arizona DUI charge and case against you.
Primarily, these apply as you are pulling out of the parking lot (a private drive) onto the street.
1. Failing to come to a complete stop prior to the sidewalk portion of the drive.
2. Failing to signal which way you will turn from the private drive.
3. Turning onto the roadway in a lane other than the curb lane, i.e., the closest lane practicable.
Once you have exited the bar parking lot, they will watch you turn from one street to the other. They will pull you over for a police stop if you fail to turn into the closest lane practicable while executing your turn. The police refer to these are the wide left or right turn.
Keep these things in mind when you are exiting a bar or restaurant late at night. Be extra careful and assume there is a cop watching as you leave.
